What does martial law mean in the new regions of the Russian Federation, introduced by Putin’s decree

President Vladimir Putin signed a decree on the introduction of martial law on the territory of the recently annexed regions of Russia – the DPR, LPR, Kherson and Zaporozhye regions. We explain what this means, according to Russian law, and how martial law can affect the lives of civilians.

The declaration of martial law means the introduction of a special regime throughout the state or on part of its territories by the decision of the President of Russia in the form of a decree. The Federation Council must approve the introduction of martial law in the country by a majority vote within 48 hours. If the Federation Council rejects the presidential decree, it loses its force the very next day. Today, senators will gather for an extraordinary evening session to consider the presidential decree.

In the event of a declaration of martial law, all management in this territory passes into the hands of the military administration. 

Martial law is declared in the presence of external armed aggression or a threat to the territory of Russia from another state. Aggression can be in the form of an invasion, the use of weapons against the subjects of the Russian Federation, the actions of sabotage and reconnaissance groups, the blockade of strategically important objects or the coastline, as well as if the border state has allowed its territory to be used for an attack. In addition, martial law may be imposed in case of other security threats.

The presidential decree lists the territories where martial law is imposed, restrictions that come into force from the moment martial law is imposed, and also notes which legislative acts suspend their effect.

When martial law is declared, every person liable for military service from the reserve must immediately arrive at the place of assembly or the location of the military unit.

Conscription of military personnel from the reserve is determined by an administrative act of the President of Russia or by separate orders of the Ministry of Defense of the Russian Federation.

In the event of a declaration of martial law in the country, the economy is rebuilt to produce products for state needs, as well as the army. Some rights and freedoms of Russian citizens and foreigners may be restricted.

The authorities may also introduce such measures:

– enhanced measures to protect objects of strategic importance and public order;

– special mode of functioning of the transport network, communications and communications, energy;

– possible evacuation of not only citizens, but also important objects of economic, public or cultural purpose;

– installation of checkpoints with control of movement to and from the zone where martial law is in effect;

– suspension of the work of all political parties, social and religious movements. Any rallies and strikes are banned;

– possible seizure in favor of the state of certain types of property, for example, vehicles, with payment of compensation. Companies are also obliged to provide the property necessary for the needs of defense, which is in their ownership;

– possible involvement of the civilian population in work at defense enterprises, including the dismantling of rubble, restoration of facilities, fire fighting, etc.;

– curfew with the detention of violators for up to 30 days, as well as a “dry law”, implying a ban on the sale of alcohol;

– strict censorship of the media and other means of transmitting information, up to a complete shutdown of the Internet;

– isolation of citizens of aggressor states;

– temporary restrictions on financial activity and economic transactions.

Martial law is abolished by presidential decree after the elimination of the circumstances that served as the basis for its introduction. The population will be notified about this in the same order in which it was notified about the introduction of martial law.

According to Putin’s Decree, martial law in the DPR, LPR, Zaporozhye and Kherson regions will be introduced at 00:00 on October 20.
